Welcome to atelierpetit.com (the "Site"), the official online home of Atelier Petit ("Atelier Petit," "the company," "we," "us," or "our"). These Terms of Service (the "Terms") set out the agreement between you and Atelier Petit whenever you visit the Site, register an account, place an order, or otherwise use any service we offer. Please read this carefully before completing a transaction, as proceeding to checkout indicates your acceptance of every provision below.

If you do not agree with any portion of these Terms, please refrain from using the Site.

1. Definitions

  • "Customer," "you," and "your" refer to any individual visiting or purchasing from the Site.
  • "Goods" refers to any product offered for sale on the Site.
  • "Order" refers to any request you submit through the Site to purchase Goods.
  • "Content" refers to text, images, photography, illustrations, videos, logos, code, and any other material displayed on the Site.

2. Eligibility

When you access the Site, you represent that you are at least eighteen (18) years of age, or that you are doing so under the supervision and with the consent of a parent or legal guardian. Accounts opened or orders placed by minors without such consent are not authorised and may be cancelled at our discretion.

3. Account Registration

You may create a customer account to streamline future purchases. In doing so, you are responsible for:

  • Providing accurate, current, and complete information
  • Keeping your login credentials confidential and secure
  • All activity that takes place under your account

We reserve the right to suspend or close any account where we suspect fraudulent activity, breach of these Terms, or misuse of our services.

4. Order Acceptance and Formation of Contract

Submitting an Order constitutes an offer by you to purchase the Goods listed. No binding contract exists until we have issued a written order confirmation by email. We may refuse or cancel any Order at our discretion, including for:

  • Errors in the product description, image, or price
  • Suspected fraud or unauthorised use of payment methods
  • Limitations on quantities available
  • Shipping restrictions affecting your delivery address

Where we cancel an Order after payment has been taken, the full amount is refunded to the original payment method without delay.

5. Product Information and Availability

We take reasonable steps to describe and depict every product accurately. Even so, photography may not capture exact colours, finishes, or textures due to screen and lighting variations; inventory levels can change rapidly; and we may withdraw, discontinue, or alter the specification of any item at any time without prior notice.

6. Pricing

Pricing is quoted in United States Dollars (USD) and is exclusive of applicable taxes, duties, and delivery charges, which are calculated and displayed at checkout. If a pricing error is discovered after you place an Order, we will contact you with the correct price and the option to confirm at the corrected amount or cancel for a full refund.

7. Payment

We accept the major credit and debit cards displayed at checkout, plus any alternative payment methods made available from time to time. By submitting payment, you represent that you are the rightful holder of the card or account used and that sufficient funds are available. Orders are not processed until payment has cleared, and we may cancel any Order where authorisation has been refused.

8. Promotional Codes and Discounts

From time to time we may issue promotional codes, gift vouchers, or other discounts. Unless explicitly stated, codes cannot be combined with other offers, carry an expiry date, are non-transferable, and hold no cash value. We reserve the right to withdraw any promotion at any time and to refuse codes we believe have been obtained or used in violation of these Terms.

9. Shipping and Delivery

Our shipping framework — including that Goods are dispatched from our international fulfilment centre, along with handling timelines, carrier options, and estimated transit windows — is detailed in our Shipping Policy, which forms part of these Terms by reference. Any timeframe we communicate is provided in good faith as an estimate and is not a binding commitment. We do not accept liability for delays beyond our reasonable control, including carrier disruption, customs processing, severe weather, or other force majeure events.

10. Risk and Title

Title to and risk of loss in any Goods passes to you at the moment the courier hands the parcel over at your delivery address.

11. Returns and Refunds

The conditions under which Goods may be returned or exchanged are set out in full in our Return & Refund Policy, which forms part of these Terms by reference.

12. Permitted Use of the Site

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only.

13. Prohibited Conduct

You agree that you will not use the Site for any unlawful, fraudulent, or harmful purpose; attempt to access areas you are not authorised to access; reverse engineer, scrape, or harvest data by automated means; interfere with or place unreasonable load on the Site; upload viruses or malicious code; impersonate any person; or reproduce or exploit any Content without our prior written consent. Breach may result in immediate termination of your access, in addition to any other remedies available to us.

14. Intellectual Property

All Content on the Site, including the name Atelier Petit, our logos, product names, photography, written copy, and the design and layout of the Site, is the exclusive property of Atelier Petit or its licensors and is protected by United States and international intellectual property laws. Nothing on the Site grants you any licence to use our intellectual property except as expressly set out in these Terms.

15. User-Submitted Content

If you submit reviews, comments, photographs, or other material, you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sub-licensable licence to use, reproduce, modify, publish, and display that material in connection with our business. You represent that any material you submit is your own work, does not infringe third-party rights, and is not unlawful, defamatory, obscene, or otherwise objectionable. We reserve the right to remove user-submitted content at our discretion.

16. Third-Party Links and Services

The Site may contain links to or integrations with third-party services, provided for your convenience only. We do not endorse, control, or accept responsibility for the content, products, or practices of any third-party site, and your interactions with third parties are governed by their terms, not these.

17. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms by reference.

18. Disclaimer of Warranties

The Site, and all Content and Goods offered through it, are provided on an "as is" and "as available" basis. So far as the law permits, Atelier Petit disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no representation that the Site will be uninterrupted, error-free, or secure.

19. Limitation of Liability

So far as the law allows, Atelier Petit and its officers, employees, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; any loss of profits, revenue, data, goodwill, or business opportunity; or any damages arising out of your use of or inability to use the Site or any Goods. Where liability cannot be excluded, our aggregate liability in connection with any single Order shall not exceed the total amount paid for the Goods giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

20. Indemnification

You agree to indemnify, defend, and hold harmless Atelier Petit and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or Content, or your violation of any law or third-party right.

21. Force Majeure

Atelier Petit shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, government action, strikes, courier or supplier failures, customs delays, internet outages, or cyber attacks.

22. Termination

We may, at our discretion and without prior notice, suspend or terminate your access to the Site if we believe you have breached these Terms or engaged in conduct that may damage our business, reputation, or other customers. Termination does not affect rights or obligations accrued before the date of termination.

23. Dispute Resolution

Informal resolution. Before commencing any formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@atelierpetit.com and setting out the nature of the complaint. We will work with you in good faith to find a resolution within thirty (30) days of receiving your notice.

Binding arbitration. If the dispute cannot be resolved informally, both parties agree that any claim arising out of or relating to these Terms or your use of the Site shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. To the extent permitted by law, you and Atelier Petit agree to bring any dispute on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative proceeding.

24. Governing Law and Jurisdiction

These Terms are interpreted and enforced under the laws of the State of New York, United States, without regard to its conflict of laws provisions. Where arbitration does not apply, you agree that the state and federal courts located in New York shall have exclusive jurisdiction.

25. General Provisions

  • Entire agreement. These Terms, together with the Privacy Policy, Cookies Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Atelier Petit regarding your use of the Site.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver. Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
  • Notices. Notices to Atelier Petit should be sent to support@atelierpetit.com. Notices to you will be sent to the email address you provided at registration or checkout.

26. Changes to These Terms

We may revise these Terms from time to time. The current version will always be available on this page, marked with the most recent effective date. Continued use of the Site after revisions are posted constitutes your acceptance of the updated Terms.
